The Officer Michael Thomas Kominsky Sr. Scholarship Fund ("the Fund," "we," "our," "us") is a charitable initiative established to honor the legacy of Officer Michael Thomas Kominsky Sr. and to provide scholarships to eligible students pursuing careers in law enforcement or related fields. By accessing our website, submitting a scholarship application, making a donation, or otherwise engaging with the Fund, you ("you," "your," "applicant," "donor") agree to the following Terms and Conditions.

Use of Funds
Scholarship funds awarded are intended exclusively for educational purposes, including tuition, required fees, books, and related expenses at accredited institutions. Misuse of awarded funds may result in forfeiture or repayment obligations at the Fund’s discretion.

Eligibility
Scholarship applicants must meet all eligibility criteria outlined in the application materials. Providing false, misleading, or incomplete information may result in disqualification, revocation of an award, and/or legal action.

Donations
All donations made to the Fund are voluntary, non-refundable, and tax-deductible to the extent allowed by law. The Fund is a recognized 501(c)(3) nonprofit organization. Donors will receive an acknowledgment letter but no goods or services of substantial value in return for contributions, in accordance with IRS regulations.

Intellectual Property
All content, including logos, images, text, and other materials published by the Fund, is the property of the Fund and may not be used without prior written consent.

Limitation of Liability
The Fund, its board members, volunteers, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your participation, application, donation, or interaction with the Fund.

Amendments
The Fund reserves the right to modify these Terms and Conditions at any time without prior notice. Changes will become effective immediately upon posting on the Fund’s website or other official communication channels.
Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
